FINAL Same Sex Marriage Proposal

The last couple years the buzz around the country about same sex marriage has been huge; even though this topic is often surrounded by much controversy, it is very important. The problem is that we are a country primarily based on freedom and taking away an individual’s right to marry is taking away a freedom. I propose that same sex marriage be made legal.

In 1996 the federal government, under the supervision of President Bill Clinton, passed DOMA or the Federal Defense of Marriage Act, that states that a marriage is to be recognized between a man and a woman, and that another state does not need to recognize or uphold a same sex marriage. Setting this organization in place protected many opponents’ beliefs and standards. In the act it states that the words “spouse” and “marriage” will only pertain to a union between and man and woman. The act also states that no other state is required to uphold other states laws. So, what that means is that a same sex couple was to marry in Iowa then travel to Utah, Utah does not have to consider that marriage as valid.

Currently there are only 6 states/districts that have made same sex marriage legal. They are: Iowa, New Hampshire, Massachusetts, Connecticut, Vermont, and Washington D.C. 6 states allow domestic partnerships, they are: Washington State, Oregon, Nevada, California, Hawaii, and Maine. 2 states allow civil unions, they are: New Jersey, and Illinois.

The hype around the passing of Proposition 8 in California has been huge. The clause would allow the California Constitution to state that “Only marriage between a man and a woman is valid or recognized in California” After the passing of the clause on November 5, 2008 the hype about same sex marriage was intensified. Supporters of the clause argued religion, education, adoption, and tax rights. People against the clause argued equality and unfair treatment, and financial and tax privileges.

First I will talk about the opponent’s arguments. Education: The argument is that if the law proposition 8 is passed that educational institutions will have to teach that same sex marriage is indeed normal and acceptable, and is in every way equal as traditional marriage between a male and female. Adoption: If Proposition 8 is not passed adoption agencies would be forced to serve all same sex couples. Religion: Clergymen and religious people argue from the Bible stating that the foundations of marriage are based solely on a man and a woman. Also, they are worried that religious sects may be accused of hate crimes if they reject or choose to not allow a same sex couple to hold ceremonies in their buildings. Tax Rights: Some religious institutions are worried that they will lose their tax exemption status. Also there are concerns that there will be people that take advantage of the tax benefits that married couples receive.

Here are the weak points in those arguments. Education: In an ever increasing dynamic country, we should educate our children on all things. In order to have well rounded, un-sheltered children that are ready for every issue and topic, we need to teach them, or introduce them to it. I do not believe that it is any schools responsibility or feel it’s necessary to teach “right” or “wrong” concerning this topic. But, presenting that there are same sex couples and that marriage is a union and partnership formed between two people is just stating and teaching a fact, and better preparing children for the world that is around them. The Education Code itself also reads: “Family health and child development, including the legal and financial aspects and responsibilities of marriage and parenthood.” Nothing states that it will be required to define marriage as what it is or what is right or wrong. It is also always the parent’s choice to withdrawal their child or children from any course or classroom where they do not agree with the course content or criteria.

Adoption: Denying a same sex couple the opportunity to raise a child is unfair, and infringes on those couples constitutional rights. There are many same sex couples that are more fortunate than heterosexual couples and can provide a life and environment that would be wonderful for a child. Using this as a reason for why someone should not be allowed to adopt a child is like saying that all single parent children are less likely to succeed. These statistics do not take every couple or situation into account. Same sex couples should be treated equally. Thousands upon thousands of children go without homes each year. More agencies offering options to homosexual males and females would offer a way to reduce this number. This would leave us with less children in the system and more children with loving homes. The Child Welfare League of America had this to say: “Applicants should be assessed on the basis of their abilities to successfully parent a child needing family membership and not on their race, ethnicity or culture, income, age, marital status, religion, appearance, differing lifestyles, or sexual orientation.” As quoted by CWL position statement on same sex marriage (2000). They also list in the article a statement issued by the American Psychological Association; the statement says: “Existing research comparing lesbian and gay parents to heterosexual parents, and children of lesbian and gay parents to children of heterosexual parents, shows that common negative stereotypes are not supported (Patterson, 1995). Likewise, beliefs that lesbian and gay adults are unfit parents have no empirical foundation” (American Psychological Association, 1995)

Religion: A very sensitive topic for many people. Stating or basing a decision off of the Bible alone is ludicrous. If we were to live by every law or commandment that was stated in the Bible we would be sacrificing animals and getting executed for almost everything. In DEUTERONOMY 22:13-21 it says: "If it is discovered that a bride is not a virgin, the Bible demands that she be executed by stoning immediately." In LEVITICUS 15:24 "If a man lies with her and her monthly flow touches him, he will be unclean for seven days; and any bed he lies on will be unclean.” In DEUTERONOMY 21:8 it says: “If a man has a stubborn and rebellious son who does not obey his father, his father shall take hold of him and bring him to the elders. They shall say, this son of ours is stubborn and rebellious he is a profligate and a drunkard. Then all the men of this town shall stone him to death” There are many things that are outdated in the Bible, and no longer apply to times today and to the way that we live our lives. There are so many things that we don't follow suit in the Bible that it is ridiculous to hold on to one passage that says that a marriage should be strictly between a woman and a man and not hold on to hundreds of other passages that require us to do equally ridiculous things. You cannot argue that the book is legitimately true and perfect when you don't follow every aspect.

Also, in the Christian religion you are taught not to judge others. That Jesus Christ and God have the final say in these matters. But, Christians everywhere have taken it upon themselves to rally together forming anti same sex marriage groups and rioting at different events. The LDS church alone has been reported to have spent more than 20 million dollars on the California Proposition 8 advertisement campaign. Recently, a group in San Francisco held signs that said homosexuals were going to hell. If you are Christian than aren’t you supposed to believe that Christ holds the ultimate judgment? Aren’t you supposed to “Love your neighbor as yourself” as it is quoted in the Bible?

The most recent controversy concerning religion is when the LDS church leader Boyd K. Packer announced in their annual meeting “General Conference” that living and practicing a gay or homosexual lifestyle is “immoral and evil”. The feedback from these statements has been heavy. Many homosexuals in Utah are outraged. Along with church members that do not agree with the words or new findings of the church concerning this topic. There is a scheduled protest October 7th regarding this particular topic. Adam (Eric) Pride in Utah Blog, Entry 1 & 2.

Tax Rights/Hate Crimes. Religious institutions will not be affected by the passing of this bill. No religion will be asked or to change its views on the topic, or be expected to perform religious ceremonies which would make them go against the teaching of their doctrine. This can be compared to the Mormon Church only allowing those members that are “endowed” and hold a current temple recommend to enter into marriage through a temple ceremony, and not allowing others that are not to view or be a part of that ceremony. Many institutions have worship areas that are not open to all the public. These instances are not considered hate crimes. In the California ruling issued on May 15th the Supreme Court actually issued a statement protecting those rights. U.S. District Judge Vaughn Walker said:

“[A]ffording same-sex couples the opportunity to obtain the designation of marriage will not impinge upon the religious freedom of any religious organization, official, or any other person; no religion will be required to change its religious policies or practices with regard to same-sex couples, and no religious officiant will be required to solemnize a marriage in contravention of his or her religious beliefs.
“Marriage in the United States has always been a civil matter,” Walker continued. “Civil authorities may permit religious leaders to solemnize marriages but not to determine who may enter or leave a civil marriage. Religious leaders may determine independently whether to recognize a civil marriage or divorce but that recognition or lack thereof has no effect on the relationship under state law.” As quoted in Supreme Court Ruling. I recently interviewed a homosexual male to get a little bit more back story behind the reasons why same sex marriage is so important to him. His name is Jaymes Myers; he is currently a teacher at the University of Utah and Salt Lake Community College. This is what he said:

“When the government withholds same sex marriage as an option for homosexual men and woman, not only are they infringing on our constitutional rights, but there are many other things that are affected by that decision. For example; currently legislation has it set up that if a loved one, or a partner in this case, is ill or sick in the hospital only family members are able to see or attend to that person. Because that is the current rule, no same sex partnership qualifies. This is a ripple effect that spans farther than just freedom. It affects or everyday lives, and relationships.”

Can you imagine what it would be like to not be able to be with your loved one or spouse at the most crucial time in your relationship? To not be able to act on their behalf if they were to pass away, to be left nothing if a will was not made. These are all realities for homosexual couples that aren’t ever really thought about.
Same sex marriage is not a new topic, it has been around for years. But, because of the hype around proposition 8 in California it has brought new light to the situation and made many more people aware.

"This is a day of immensely conflicted feelings. We are profoundly disappointed the court has upheld Proposition 8. Banning the fundamental freedom to marry for same-sex couples is unfair, unjust and flies in the face of progress occurring throughout the country, from the Iowa heartland to the rocky shores of Maine. That California is taking a step backward at this moment in history is disconcertingly out of step with society's growing support for equality, and personally painful to committed couples who will be blocked from marrying in California. It is a travesty that the court has, for the first time in California history, permitted a simple majority to use the initiative process to strip a fundamental right from a minority group." Understanding the reason behind opponents wanting to ban same sex marriage is not the issue. Understanding why those reasons outweigh constitutional rights when we are a country primarily based on freedom is.

So, I propose that we take the steps necessary to change The Federal Defense of Marriage Act. The words “Spouse” and “marriage” should be defined as a legal union between two persons opposite sex couples and same sex couples included. And the law that says a state does not have to uphold or consider a same sex marriage valid should be stricken. I also propose for the eventual legalization of same sex marriage in all 50 states.

So where do we start on the road to change? Getting each state to pass same sex marriage would be no easy task, however it is obtainable. The first step to be made is to campaign, to educate people on the rights of individuals. To explain the importance of same sex marriage and the effects it is having on thousands of individuals. I would say that most people are ignorant in knowing the details that are in sex marriage and that it spans far greater than just a homosexual relationship. I would educate people that it is a far deeper situation. The points I would highlight are:

The Declaration of Independence: “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the Pursuit of Happiness.” Thomas Jeffereson, Declaration of Indepenence.

The very foundation that we are built upon states that all men should be given certain rights and remain equal, I would argue that a heterosexual relationship is no different than a homosexual relationship if you look at it strictly by that point. I would also argue the separation of church from state. In the first amendment it states:

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”United States Constitution, Amendment 1.

Because of the laws of separation of church and state, the reasons solely behind why a same sex partnership should not be allowed to marry are irrelevant. Our country is afraid of change. But it can be done. In 1924 a ban on interracial marriages was passed that stated that you could only marry someone that is the same skin color as you. In 1967 the law was struck down by the Supreme Court and interracial marriages became legal. The Supreme Court deemed the old law “unconstitutional”. Saying: “The freedom to marry has long been recognized as one of the vital personal rights essential to the orderly pursuit of happiness to free men, a basic civil right” Loving vs Virginia Supreme Court Case June 12, 1967.

The projected cost of something this extreme is unknown. Various fundraisers, donations, and sponsors would be needed. This would be a long and costly road. But, the outcome would be great. The moral and support of homosexuals would skyrocket, and our country would make another huge leap forward in remaining true to our roots in regards to freedom. Many people like to compare these two cases because of the similarities in the infringement of rights. It took almost 45 years for change to occur but it did happen. In an interview Mildred Loving had this to say: “I am still not a political person, but I am proud that Richard's and my name is on a court case that can help reinforce the love, the commitment, the fairness, and the family that so many people, black or white, young or old, gay or straight seek in life. It is my hope to see in the future to see that same sex marriage be legalized in all 50 states, that same sex partners everywhere get the freedoms that heterosexual partners are already enjoying, and that rather than stifling a very important topic because some people may not be comfortable; it is brought to light and people are educated on the importance of everyone being equal. Marriage is a human right, not a heterosexual privilege.

Proposal Thesis Statement

Understanding the reason behind opponents of same sex marriage is not the issue, understanding why those reasons outweigh constitutional rights when we are a country primarily based on freedom is. It is my hope to see in the future that same sex marriage be legalized in all 50 states, that same sex partners everywhere are given the freedoms that heterosexual couples are already enjoying, and that rather than stifling a very important topic, it is brought to light and people are educated on the improtance of the foundation our country was created uponm which is: All men are created equal.

The Pitch

Hi, I'm Stephanie Suarez. I'm a student at Salt Lake Community College. I go to the South City Campus.

Recently, I was walking through the halls after a class and all of a sudden felt a rumble in the pit of my stomach. I realized something, I was hungry. I started scavenging the campus for a good place to eat and came to the conclusion that there was no good place to eat. Only a dinky express store that offered only minimal items. I propose to you today that we add more choice and availability for food at the South city campus.

Giving the students more options for food choices would offer many benefits to the campus.

1. It would allow for students to stay on campus for food rather than venturing off campus, thus bringing money in.
2. It would satisfy current students looking for variety and give South City an edge over other campus's
3. It would appeal to future SLCC students and boost enrollment rates.
4. It would also offer jobs to SLCC students

The initial cost of this project might be great. However, due to the need and demand I am confident that the school would make it's money back in no time. Fund raising can be done, and we can also look into the schools annual budget.

I end this proposal by saying that all of us have felt the rumbling at the bottom of our stomachs at some point or another. Help South City Campus students end that rumbling, and make more food options available.

Evaluation -- Android Generation FINAL

The overly hyped and often talked about Android is a hot topic across the nation right now. Many young and old people alike are drawn to the phone for its “cool” features. Even though there are many “Droid” phones to choose from, I will be talking about the HTC Droid Incredible by Verizon, the emphasis IPhone 4 by Apple carried by AT&T, and the HTC Evo by Sprint. These phones are rated some of the best Droid and application phones on the market, hopefully through this evaluation I will be able to narrow down which phone is best.

The HTC Droid Incredible offers all the shiny features that a “Droid” lover would expect. It has touch screen capabilities and offers a full Qwerty keyboard, 8 MP Camera, Google & Facebook Contact exchange, 8GB of memory, 1 GHZ of snap dragon processing, 3.7" HD screen, Bluetooth, GPS, and many other “cool” features. The look of the phone is also appealing. It has a slim and lightweight structure.

But, with a “Droid” phone almost all those things are expected. So, what makes this particular phone different? Have you heard of Skype? It is a free web application that allows people to talk for free. Usually this is done over a home computer or laptop, however, with the Droid Incredible you are able to do this through your phone. The phone offers 3G hotspot service, and is also WiFi capable. And, you can even talk to text. So, for all those drivers that just can’t keep their hands off their phones while texting, this phone offers you a feature where you can actually speak to the phone and it will text what you are saying. This phone also offers V Cast Media storage that allows you, for a small fee, to store any files or MP3’s that you might have online and access them through any computer or compatible phone.

So, what are the downfalls or draw backs of this phone. After looking at reviews on Verizon.com, I found these results: The battery life is poor, with all the features this phone offers the battery just doesn’t hold up. Because of all the applications and “shiny” stuff the phone freezes and isn’t very reliable. Poor antenna and signal capabilities, and poor sound quality. Charging to store information, even though the lowest price starts off at 2.99 a month it would be much easier and more cost effective for someone to pick up a flash drive for $5.00 and store the information themselves. Also, the skype feature is cool, however, it would be even better if the video chat feature was enabled and the camera was facing the front of the screen. But, in the incredible case the camera is located in the back which is a huge downfall for the phone. I also interviewed a couple friends with the Droid Incredible.

After speaking to him I realized that he wasn’t excited about this phone. He was a new owner of the Incredible, that being the case, I expected an certain excitement from him, or for him to want to show off the incredible, or explain why THIS phone was the best Droid on the market and why I should go out and purchase it today. But, that was lacking in our conversation.

Because we are in an economic recession Verizon recognizes that not many families and average Joe people are able to afford an extra $300 dollars up front. So, they offer the 2 for 1 deal. Buy any phone (Droid Incredible included) and get the second one free. That being the case, It would drop the phone (after rebate) to $100 per phone, which is a huge discount.

I wanted to see a couple reviews on the Incredible so I went to the website Engadget.com. This website rates phones on a 10 point basis. Engaget.com rated HTC Droid Incredible 8/10. The good factors that it pointed out were: It is extremely fast, Sense UI makes Android feel polished, and great sound quality. The Bad qualities were: The screen is hard to see in the sunlight, the design might not be for everyone (it has a soft back cover designed around a race car), and the camera can be slow to focus. So, overall this phone is flashy, sleek and offers the capabilities that a Droid user would expect. But, for a person that has never used a Droid before this phone might be a little complex to navigate, and better battery life would be expected. However, for the price you are paying, the Incredible is appealing to everyone. It is overall a good and affordable phone.

So, now let’s talk about the Iphone 4. The Iphone 4 has all the fancy gadgets that you might expect, but it takes it to another level. This phone offers 3G service capabilities, WiFi, 5 MPX camera, Facebook and Google contact exchange, GPS, a large display with new “retina display features”, sleek and lightweight, comes in 16 GB or 32 GB, and many other amazing features.

So, what sets this phone apart? Where do I start. Like the HTC Droid Incredible this phone offers the feature Skype. However, with the camera facing the front you are able to get what apple calls “facetime”. This feature actually allows you to video conference a loved one. It also offers a Retina display that has 4 times the pixel amount of any previous iphone and makes it the highest resolution phone on the market. It offers HD video recording, it has a built in ipod and itunes, it has built in voice control that allows you to access a song or a contact with your voice. Also one of the coolest features I think is tethering. It gives you the ability to access the internet on your computer through tethering through your phone, which is a great way for everyone to save money on internet costs.

All of these features are very impressive. But, what are the downfalls? Because there were no reviews for the phone located on apple.com or attwireless.com I turned to Engadget.com once again. Engaget.com rates the Iphone 4 9/10. This is what they had to say: The good things included, amazing new industrial design, retina display is stunning, iOS 4 makes major improvements. With all that being said, what is the price of this phone? The phone without a package is not available, you must have a two year contract. The 16 GB phone is offered at $199.99 and the 32 GB phone is offered at $299.99. Those prices are for the phone only, and don’t included your monthly service plan. And, this phone also requires that you purchase a data plan with the phone.

All, in all the Iphone 4 is a great phone. It has many great features and is at the top of it’s market for its capabilities. However, this phone would not be appealing to average middle class family because of the price and plan structure.

The next phone I’m going to talk about is the Evo 4G by Sprint. This phone offers 4G speeds, and a 1 GHZ snapdragon processer. 4.3 inch screen, Hotspot capable, Bluetooth, memory card slot, Facebook and Google contact exchange, 3G speeds when 4G is not available, 8 MPX camera.

So, what makes sets this phone apart, what are the perks of the Evo 4G. Here are a few: 720p video capabilities. This allows you to take videos with great clarity and focus. It offers a duel camera 8 MPX from the back, and a 1.3 MPX front facing camera that allows you to do video conferences, or “skype”. The phone has Sprint TV with a kick stand that allows you to set your phone up on a table or hard surface so you don’t have to hold the phone in place. It includes WiMAX, and FM radio.

What are the downfalls of this phone? After looking at reviews on sprint.com this is what people had to say: The phone is almost too big to fit in your hand and can be awkward to carry around. The wireless range and antenna capabilities are lacking. After sifting through pages of reviews on sprint.com these are the only bad comments or “downfalls” that I could find. Most customers gave the EVO a 5 star rating.

Engadget.com rated the EVO 4G 9/10. The things they liked about the phone were: Huge, vibrant display, mobile hotspot works beautifully, WiMAX compatibility. The dislikes were: Nearly too big for one handed use, WiMAX can be spotty; 720p video quality wasn’t that great. For a full review visit http://www.engadget.com/2010/05/19/htc-evo-4g-review/.

So, what is the price for this high tech flashy phone? Without a contract the phone sells for a whopping $449.99. With a new line or eligible upgrade you can get an instant savings of $150.00 and a mail in rebate off $100.00 which drops the phone down to $199.99. This might be a little expensive for a family or average Joe.

So, which phone is most cost effective for a family or average user? I would say the Droid Incredible. The phone after rebate is $199.99 but Verizon offers that you buy one phone and get another free. For that reason the phone would be ideal for people that are looking for a great, functional quality Droid phone for a reasonable and affordable price. Which phone would be best for the Droid or application guru? I would have to say the Evo 4G. This offers all the Droid applications that you would expect but also offers much more.

Evaluation -- Android Generation Draft 2

The overly hyped and often talked about Android is a hot topic across the nation right now. Many young and old people alike are drawn to the phone for its “cool” features. Even though there are many “Droid” phones to choose from, I will be talking about the HTC Droid Incredible by Verizon, the emphasis IPhone 4 by Apple carried by AT&T, and the HTC Evo by Sprint. These phones are rated some of the best Droid and application phones on the market, hopefully through this evaluation I will be able to narrow down which phone is best.

The HTC Droid Incredible offers all the shiny features that a “Droid” lover would expect. It has touch screen capabilities and offers a full Qwerty keyboard, 8 MP Camera, Google & Facebook Contact exchange, 8GB of memory, 1 GHZ of snap dragon processing, 3.7" HD screen, Bluetooth, GPS, and many other “cool” features. The look of the phone is also appealing. It has a slim and lightweight structure.

But, with a “Droid” phone almost all those things are expected. So, what makes this particular phone different? Have you heard of Skype? It is a free web application that allows people to talk for free. Usually this is done over a home computer or laptop, however, with the Droid Incredible you are able to do this through your phone. The phone offers 3G hotspot service, and is also WiFi capable. And, you can even talk to text. So, for all those drivers that just can’t keep their hands off their phones while texting, this phone offers you a feature where you can actually speak to the phone and it will text what you are saying. This phone also offers V Cast Media storage that allows you, for a small fee, to store any files or MP3’s that you might have online and access them through any computer or compatible phone.

So, what are the downfalls or draw backs of this phone. After looking at reviews on Verizon.com, I found these results: The battery life is poor, with all the features this phone offers the battery just doesn’t hold up. Because of all the applications and “shiny” stuff the phone freezes and isn’t very reliable. Poor antenna and signal capabilities, and poor sound quality. Charging to store information, even though the lowest price starts off at 2.99 a month it would be much easier and more cost effective for someone to pick up a flash drive for $5.00 and store the information themselves. Also, the skype feature is cool, however, it would be even better if the video chat feature was enabled and the camera was facing the front of the screen. But, in the incredible case the camera is located in the back which is a huge downfall for the phone. I also interviewed a friend with the Droid Incredible.

After speaking to him I realized that he wasn’t excited about this phone. He was a new owner of the Incredible, that being the case, I expected an certain excitement from him, or for him to want to show off the incredible, or explain why THIS phone was the best Droid on the market and why I should go out and purchase it today. But, that was lacking in our conversation.

Slam -- Here's a tip for you

When I walked into the restaurant I could already tell that my time there was going to be less than pleasant. With my son perched on my hip and baby bag weighing on my shoulder I began to wait. My friend was more patient than I was because after 5 minutes of seeing no one, I began looking for the “bell” that I must need to ring in order to get service.

There was no sign of anyone, customers or servers of any kind. I began saying “Hello?!” Finally, someone came to the front. The hostess looked as if she were in hell, not a smile or a Oh, I’m sorry for the wait. Party of 3? This way.

As we all shuffled to our table, which mind you they had placed right next to a can of garbage, I asked the server if she could please bring a high chair for my son. Who by this time was overly hungry, and letting us all know it by waving his arms in the air and hitting me in the face.

As I waited patiently for the high chair and our server, I realized that I was going to have to take matters into my own hands. I passed my son off to my friend, and began searching for a high chair, and a server. I found both. As I was pulling the high chair back to our table I said

“Can we please get some menus? And maybe some water..”

“Oh, yes, sorry.. I’ll be right out” she said.

The server came out in what seemed to be the dirtiest apron I’ve ever seen, and set our glasses of water down on the table. After staring at her dirty fingernails as she handed me the water with “floaties” towards the top I decided I wasn’t so thirsty afterall.

I decided to order. Because I am a server, I have a lot of sympathy towards servers and restaurants in general. I know that guests do not always take into account everything that a server is doing, so I tried to be as patient and understanding as possible.

I ordered my meal, and my sons meal and waited.. and waited.. and waited… I got my servers attention.

“Is there a problem? I’m just wondering what’s taking so long?”

“Oh, oh yeah.. Your food will be right out”

By this time my son was in full tantrum mode. He was hungry and he was not happy with me or anyone for that matter.

Finally the server brought out our dishes. And, surprisingly even though the presentation of the food looked like it was slopped on plate as a way that you would be feeding some sort of animal, the taste wasn’t bad.

After the food was delivered we saw no sign of our server again. No check backs. No water refills for my friend who had braved the “floaties” and decided to drink it anyway. Nothing. I even had to go to the front desk to get my check.

Like I said, I’m a server so I’m usually understanding to almost every situation. But, in this case… I was not so happy. I was actually pissed by this point. I grudgingly pulled out the amount on my ticket to pay my bill. As the person asked if I wished to leave a tip I said:

“Yes, here’s a tip. If you’re a server, that generally means you have to serve people. So, if you want a tip, then how about you wash your hands before you serve the food, so I don’t want to vomit in my mouth as you slide me my water which by the way had things floating in it; And, how about you actually check back at least once while I’m here. Just because you look like hell, doesn’t mean you have to treat your customers that way, and that’s a good enough tip for her.”

That was the first and only time I had complained or said to any restaurant, and it was the first time that I left “no tip” for any server. However I thought my tip was fantastic.

Top Gear

This was my first time watching a top gear episode. I found it to be informational and entertaining. The first car that was evaluated was the Fiat 500. It was a small European car. For most it would appear too “cutsie” which is what one of the Top Gear hosts described it as. But, the evaluator, Jeremy, described it as something completely different.

When he evaluated this car he was clear, precise, and knowledgeable. He explained many details and facts about the car, for example: He described that even though the car was the size of a shoe it had 160 horse power. He was enthusiastic when delivering the facts and that made me, the listener, love this car myself. My favorite line was “It’s the kind of car that would try and make love to your leg”.
The criteria he used for describing the car were, basic make-up (engine size, speed, horse power, facts), price, handling, and overall customer appeal. Even though it was obvious that Jeremy loved this car, he still presented all the facts both good and bad.

The main perks were: price, more bang for your buck, and more economical. The main criticisms were: size, the ride was a little bouncy, and the overall look of the car could be considered too “cutsie”.

Presenting a car like the Fiat 500 showed that the show was not based on personal preference at all. I don’t think that any of the hosts of the show would personally decide that they wanted that car, or it was their dream car. However, it was presented with all the facts, and came out as an overall great buy. Jeremy even said “ this car just makes you feel happy”.

On the other end in their muscle car segment, they had 3 completely different cars that were completely based on preference. James had his luxury car the Cadillac, Jeremy had his sports car the corvette and Richard had his loud masculine muscle car. Each one of those selections was based on preference. So, in that segment preference was a big part of the show.

Editing in this section was a huge part of the evaluation; the way that the camera took different shots of the car, or enhanced the rev of the engine. Those elements played a big part on what the audience took in and how they evaluated their evaluations in a sense.

Overall, I think that the episode was great. It was comedic, informative, and insightful. I would definitely watch another episode.

Same Sex Marriage: To Be or Not To Be Final Draft

The last couple years the buzz around the country about same sex marriage has been huge; especially the hype around the passing of Proposition 8 in California. The clause would allow the California Constitution to state that “Only marriage between a man and a woman is valid or recognized in California” After the passing of the clause on November 5, 2008 the hype about same sex marriage was intensified. Supporters of the clause argued religion, education, adoption, and tax rights. People against the clause argued equality and unfair treatment, and financial and tax privileges.

First I will talk about the opponent’s arguments. Education. The argument is that if the law proposition 8 is passed that educational institutions will have to teach that same sex marriage is indeed normal and acceptable, and is in every way equal as traditional marriage between a male and female.Adoption. If Proposition 8 is not passed adoption agencies would be forced to serve all same sex couples. Religion. Clergymen and religious people argue from the Bible stating that the foundations of marriage are based solely on a man and a woman. Also, they are worried that religious sects may be accused of hate crimes if they reject or choose to not allow a same sex couple to hold ceremonies in their buildings. Tax Rights: Some religious institutions are worried that they will lose their tax exemption status. Also there are concerns that there will be people that take advantage of the tax benefits that married couples receive.

Here are the weak points in those arguments. Education. In an ever increasing dynamic country, we should educate our children on all things. In order to have well rounded, un-sheltered children that are ready for every issue and topic, we need to teach them, or introduce them to it. I do not believe that it is any schools responsibility or feel its necessary to teach “right” or “wrong” concerning this topic. But, presenting that there are same sex couples and that marriage is a union and partnership formed between two people is just stating and teaching a fact, and better preparing children for the world that is around them.

Adoption: Denying a same sex couple the opportunity to raise a child is unfair, and infringes on those couples constitutional rights. There are many same sex couples that are more fortunate than heterosexual couples and can provide a life and environment that would be wonderful for a child. Using this as a reason for why someone should not be allowed to adopt a child is like saying that all single parent children are less likely to succeed. These statistics do not take every couple or situation into account. Same sex couples should be treated equally.

Religion: A very sensitive topic for many people. Stating or basing a decision off of the Bible alone is ludicrous. If we were to live by every law or commandment that was stated in the Bible we would be sacrificing animals and getting executed for almost everything. In DEUTERONOMY 22:13-21 it says: "If it is discovered that a bride is not a virgin, the Bible demands that she be executed by stoning immediately." In LEVITICUS 18:19 "The Bible forbids a married couple from having sexual intercourse during a woman's period. If they disobey, both shall be executed." There are many things that are outdated in the Bible, and no longer apply to times today and to the way that we live our lives. There are so many things that we don't follow suit in the Bible that it is ridiculous to hold on to one passage that says that a marriage should be strictly between a woman and a man and not hold on to hundreds of other passages that require us to do equally ridiculous things. You cannot argue that the book is legitimately true and perfect when you don't follow every aspect.

The most recent controversy concerning religion is when the LDS church leader Boyd K. Packer announced in their annual meeting “General Conference” that living and practicing a gay or homosexual lifestyle is “immoral and evil”. The feedback from these statements has been heavy. Many homosexuals in Utah are outraged. Along with church members that do not agree with the words or new findings of the church concerning this topic. There is a scheduled protest October 7th regarding this particular topic. Adam (Eric) Pride in Utah Blog, Entry 1 & 2.

I recently interviewed a homosexual male to get a little bit more back story behind the reasons why same sex marriage is so important to him. His name is Jaymes Myers; he is currently a teacher at the University of Utah and Salt Lake Community College. This is what he said:

“When the government withholds same sex marriage as an option for homosexual men and woman, not only are they infringing on our constitutional rights, but there are many other things that are affected by that decision. For example; currently legislation has it set up that if a loved one, or a partner in this case, is ill or sick in the hospital only family members are able to see or attend to that person. Because that is the current rule, no same sex partnership qualifies. This is a ripple effect that spans farther than just freedom. It affects or everyday lives, and relationships.”

In 1996 the federal government passed DOMA or the Federal Defense of Marriage Act, that states that a marriage is to be recognized between a man and a woman, and that another state does not need to recognize or uphold a same sex marriage. Setting this organization in place protected many opponents beliefs and standards.

Same sex marriage is not a new topic, it has been around for years. But, because of the hype around proposition 8 in California it has brought new light to the situation and made many more people aware.

"This is a day of immensely conflicted feelings. We are profoundly disappointed the court has upheld Proposition 8. Banning the fundamental freedom to marry for same-sex couples is unfair, unjust and flies in the face of progress occurring throughout the country, from the Iowa heartland to the rocky shores of Maine. That California is taking a step backward at this moment in history is disconcertingly out of step with society's growing support for equality, and personally painful to committed couples who will be blocked from marrying in California. It is a travesty that the court has, for the first time in California history, permitted a simple majority to use the initiative process to strip a fundamental right from a minority group." Understanding the reason behind opponents wanting to ban same sex marriage is not the issue. Understanding why those reasons outweigh constitutional rights when we are a country primarily based on freedom is. It is my hope to see in the future that same sex marriage be legalized in all 50 states, that same sex partners everywhere get the freedoms that heterosexual partners are already enjoying, and that rather than stifling a very important topic because some people may not be comfortable; it is brought to light and people are educated on the importance of everyone being equal. Because as the Declaration of Independence says: “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the Pursuit of Happiness.” Thomas Jeffereson, Declaration of Indepenence.

Same Sex Marriage: To Be or Not To Be Draft 1

We live in a country that is based primarily on freedom. We pride ourselves to be a country that practices freedom of religion, freedom of speech, freedom, freedom, freedom. It seems as if on this topic freedom is not free.

The last couple years the buzz around the country about same sex marriage has been huge; especially the hype around the passing of Proposition 8 in California. The clause would allow the California Constitution to state that “Only marriage between a man and a woman is valid or recognized in California” After the passing of the clause on November 5, 2008 the hype about same sex marriage was intensified. Supporters of the clause argued religion, education, adoption, and tax rights. People against the clause argued equality and unfair treatment, and financial and tax privileges.

First I will talk about the opponent’s arguments. Education. The argument is that if the law proposition 8 is passed that educational institutions will have to teach that same sex marriage is indeed normal and acceptable, and is in every way equal as traditional marriage between a male and female. Adoption. If Proposition 8 is not passed adoption agencies would be forced to serve all same sex couples. Religion. Clergymen and religious people argue from the Bible stating that the foundations of marriage are based solely on a man and a woman. Also, they are worried that religious sects may be accused of hate crimes if they reject or choose to not allow a same sex couple to hold ceremonies in their buildings. Tax Rights: Some religious institutions are worried that they will lose their tax exemption status. Also there are concerns that there will be people that take advantage of the tax benefits that married couples receive.

Here are the weak points in those arguments. Education. In an ever increasing dynamic country, we should educate our children on all things. In order to have well rounded, un-sheltered children that are ready for every issue and topic, we need to teach them, or introduce them to it. I do not believe that it is any schools responsibility or feel its necessary to teach “right” or “wrong” concerning this topic. But, presenting that there are same sex couples and that marriage is a union and partnership formed between two people is just stating and teach a fact, and better preparing children for the world that is around them.

Adoption: Denying a same sex couple the opportunity to raise a child is unfair, and infringes on those couples constitutional rights. There are many same sex couples that are more fortunate than heterosexual couples and can provide a life and environment that would be wonderful for a child. Using this as a reason for why someone should not be allowed to adopt a child is like saying that all single parent children are less likely to succeed. These statistics do not take every couple or situation into account. Same sex couples should be treated equally.

Religion: A very sensitive topic for many people. Stating or basing a decision off of the Bible alone is ludicrous. If we were to live by every law or commandment that was stated in the Bible we would be sacrificing animals and getting executed for almost everything. In DEUTERONOMY 22:13-21 it says: "If it is discovered that a bride is not a virgin, the Bible demands that she be executed by stoning immediately." In LEVITICUS 18:19 "The Bible forbids a married couple from having sexual intercourse during a woman's period. If they disobey, both shall be executed." There are many things that are outdated in the Bible, and no longer apply to times today and to the way that we live our lives. There are so many things that we don't follow suit in the Bible that it is ridiculous to hold on to one passage that says that a marriage should be strictly between a woman and a man and not hold on to hundreds of other passages that require us to do equally ridiculous things. You cannot argue that the book is legitimately true and perfect when you don't follow every aspect.

Research

I'm planning on searching out more specific laws and regulations on Proposition 8 and going to Ellis to find scholarly better sources. I also have friends that I plan on speaking to as well on both sides of the argument.

Position Paper Outline -- Gay Marriage "To be or not to be"

Summary of Opponents' Position:

There are many different reasons that the opponent is against gay marriage. One of those reasons is religious purposes. In the Bible it states that a marriage should be between a man and a woman. So, to religious people that statement rules that there should be no same sex marriages in this country. Another factor against Same sex marriage is the children aspect. "Research" has found that many children succeed and thrive in a home with both a mother and a father. Another factor is the teaching of same sex marriage in schools. Many people are worried that if the law is passed in all 50 states that children will have to be taught about it in school and are therefore more likely to enter into such union themselves. Another factor is tax benefits. Some people are worried that friends will marry friends to gain the tax benefits or tax cuts that a married couple can obtain.

Limitations of Opponents' Position:

Saying that they have a lesser chance of being a healthy "male or female" is the equivalent to comparing them to single mothers. It is not based on the sex of the couple but the way the couple raises the children. Many other issues and weak points are found in this topic.

My understanding of the Issue:

Proposition 8 has been an ongoing issue over the last many years. States have passed and unpassed the legalization of same sex marriage. Supporters of the law believe that they are being discriminated against. They fight for equal rights, and for financial security and tax privileges that heterosexual couples have the privilege in partaking.

Reasons why my understanding of the issue is better than my opponents

Our country prides itself for being "free". Freedom of speech, free will, free, free, free. But, on this issue it seems like no one is free. Arguing that the Bible says that it isn't proper for two people of the same sex to be married is like arguing that we shouldn't eat pork anymore because the Bible says not to. Arguing that a gay couple has less of a chance of raising a healthy and well gifted child is automatically stating that all same sex partners are not capable of such things. Where in fact many same sex couples are successful and perfectly capable of providing better homes than most heterosexual couples. There's also the point of a same sex couple taking advantage of the system, but in the same sentence a heterosexual couple could take advantage of the system if they wanted to as well.

Who is the person that gets to say: "Because I believe it is morally incorrect, no marriage is not allowed" that in itself seems to be a hypocritical statement. You are free to do what you would like but you are not free to get married.


Conclusion

Write This Assignment

Fallacies appear almost everywhere now day. The ad that I chose to talk about today is a smoking ad from the 80’s. Camel is a cigarette company that used advertisement with Doctor’s to appeal to their audience. All of their advertisements from that time suggested that Doctors preferred Camel cigarettes over any other cigarette.

There were many fallacies used in these particular advertisements. Ad Populum (Bandwagon) is used where it suggests that more Doctors smoke camels than any other cigarette, and that 20,679 say “luckies” are less irritating. These statements suggest that it is the popular thing to do. That these popular and well known people smoke so you should smoke too.

These ads also use false authority and non sequitur. They suggest that because a Doctor is smoking that it is okay to smoke. They also suggest that by using their cigarette it will be not as irritating to your throat.

Slippary Slope is also used. They suggest that if you used the brand “luckiest” it will lead to a less irritated throat.

This article also points out that hasty generalization, they state in the article that cigarette companies would attend medical conventions and give Doctors a free pack of cigarettes on their way out of the event the Doctors would be asked what pack of cigarettes they had on them. This gives a false impression on how many Doctors actually smoke Camel Cigarettes.

The main goal of any company is going to be to appeal to the reader in any way that they possibly can. Using fallacies that may not be obvious to everyone helps people want to use their product.

DeathInc Draft 1

Penn and Teller are known for their unconventional outlook of exposing different topics or issues in their show Bullshit. In this episode Penn and Teller give a behind the scene view of the funeral business and its many flaws. “Living is what matters, the rest be bullshit.”

The way the material was presented allowed the episode to appeal to many different demographics; from people that have just experienced death, to people that may be preparing for death in the future, to the actual funeral industry itself.

There were also people that were relatable to the average person as well. There was a priest that discussed the markups each funeral company has in the different things they sale. And, on the other end they also used people as a way of making fun of how extreme some people can become as far as being wrapped up in the idea of death. For example: they had two people that thought they were vampires, or the owner of the company that froze bodies. Both of these cases were extreme, and exposed the viewers to a more extreme way of looking at death.

To appeal to such a wide scope of people Penn and Teller chose to present the material in many different ways. There were many facts and figures used. For ex: there are 25 million deaths each year, and the average funeral is 10,000. That being so, the funeral industry makes trillions of dollars each year off the emotionally fragile consumer.

Sarcasm and humor were also used throughout the episode. In one portion of the episode Penn says “Death isn’t so scary, as long as we put happy music to it.” Then for the rest of the episode every time there is something the least bit disturbing there is cheerful music in the background. The music is used as a buffer to soften the blow of what is actually being seen.

They discussed how most people live by the “evil eye concept” in regards to death, which means if you talk about it, it might happen to you. Stating this in the beginning allowed the viewer to be prepared for facts and information throughout the rest of the episode and set the tone.

They used Logos, Pathos, and Ethos to appeal to viewers in this episode. For Logos, presenting material and facts that were concrete. For Pathos, they reiterated that funerals are for the living not for the dead, and that we should praise the people around us while they are alive instead of when they are deceased. For Ethos, they had an inside video that exposed the funeral industry praying off of the emotionally fragile victim and presented the facts that it should not matter if you have your loved one cremated in a cardboard box because the box is going to be burned. Penn and Teller tried to stress the fact that you should not focus on trying to please the dead, but instead focus on what is important and more rational.

I think that I've narrowed down the top 5 reasons that a person would agree or take action on a topic. If a topic is extremely popular it might be seen as a trend or "the cool thing" to listen to or take action upon. Ex: The vote campaigns make voting a "cool thing" to do because of all the celebrities. The persuasiveness of a topic also, some people are very good at convincing you that something is right and persuading you to sway in their direction. If a person isn't familiar with the topic they might agree with you just because of the fact that they're unsure. Statistics are another good example, if a person sees facts that they can relate to they might be more likely to take action or agree. And, the personal beliefs or opinions will sway a person to agree or take action also.

Immigration -- Workforce services releasing information about immigrants located in Utah.

Angles-- Should workforce services be withholding this information? Privacy & Security in different government services, who actually is viewing and has access to personal information?

Polygamy-- Religious sect FLDS leader being sentenced

Angles-- Should polygamy be illegal? What social and emotional damage does this cause to children and wifes affected by it?

Use of the substance "Spice"-- Utah county has recently passed a law that prohibits anyone from using spice to get "high" in the canyons of utah county.

Angles-- What boundaries will be crossed in trying to find out if a person is "high"? Will this new fad be outlawed much like peyote?

EPortfolios-- New system set up by Salt Lake Community College to provide future students with an accumulation of "general studies"

Angles--Is this a complete waste of time? What does any student actually learn from this? What job would actually look at an eportfolio in an interview?

2. Gay marriage is a highly controversial topic in the United States today. Over the last decade it has become something that is seen in the news everyday. Proposition 8 has been something that many states have been passing and "unpassing" over the last couple years, and it's intriguing to me to see the reasons behind either the passing of the law or the denial.
